AX CAPITAL. Operations Service through Mobile Devices

Terms and Conditions of the  App for Individuals
 
My incorporation to the services of the App, will be subject and subordinate to the following clauses and conditions, which have been conceived so that the system provides an optimal service to the clients of Georgia (hereinafter the "Bank").
 
These terms and conditions are valid for all individual customers of the Bank (hereinafter, the "Terms and Conditions"). Operations Service through Mobile Devices ( App).
 
Information The service will give me the possibility of:
 
(i) use the Bank's platform for consultations and transactions called Mobile Banking (hereinafter, "Mobile Banking");
(ii) access information of general interest that the Bank provides to its customers, such as location of its branches, ATMs, search for promotions and / or any other information that, in the future, the Bank considers may be of interest . Incorporation.
 
Downloading the application To use this service, the following will be required:
 
a) Have a mobile device with Android or iOS operating system (Iphone) with Internet access and data service (hereinafter, the "Mobile Device").
 
b) Accept these Terms and Conditions,
 
c) Provide the information that is required when I join the service. Using the Mobile Device, I must download the application through the store corresponding to the modality established by each company for each Mobile Device for these purposes. In all cases I will receive the pertinent instructions to carry out the download of the application, which can be done only in case of having enough space in the mobile device used.
 
I will choose, on my own account and according to my criteria, the suppliers of the technologies and equipment required to access the App. The Terms and Conditions do not include the contracting conditions with these companies, which will be agreed directly by me with them.
 
Responsibility for the use of information
 
I. The information that I will receive operating through Mobile Banking is of strictly personal use, for which I will not select it to be sent to third parties, avoiding making mistakes that cause such result. Likewise, I will take all pertinent precautions so that the information provided by the Bank is only visualized and known by me.
 
II. The Bank provides me with the material and information necessary to operate the App properly, resulting from my sole responsibility to study said material. Likewise, I will consult the Bank's customer service channels to clarify my doubts about the service and about the information received.
 
II. The Bank is solely responsible for the proper functioning of the technological and customer management systems that are required to generate the requested information. Likewise, the Bank will only attend the queries and opinions that the clients have about the operation of the App, as long as these correspond to the operating processes for which the Bank is responsible.
 
Access to the Service.
 
Once the App is installed, I will execute the application and to access the Mobile Banking service I will provide the requested identification data: my document number, the 4 (four) digit password and my Online Banking user for validation purposes.
 
Operations When entering the  App, I will be enabled to perform all the operations that the Bank determines, including the acquisition of products and / or services, under the particular conditions of each of them and the products affected by them. The transactions carried out through this system will be taken "in firm", except those that are in opposition with others agreed on the same day or simultaneously, or that must necessarily be confirmed by the Bank.
 
In all those products in which the operation requires the signature of a previous request, this must have been subscribed and be in force, as well as, where appropriate, the accounts on which it operates must be open and without weighing on them suspension of service of payment or precautionary measures.
 
My access to any of the systems will not change or modify the aforementioned requests, not being able to perform through them any type of operation that can be interpreted as novation, remove, wait and / or tactical reconduction of another existing, in addition to not be able to suppress or diminish any guarantee constituted, keeping all of them valid.
 
If this operation or another different system is carried out, operations that contradict each other, it is understood that the only valid one is the one processed by the Bank. Update of the application. Each time you access the application, it is verified on the servers of the Bank that the latest available version is being used. If the one installed on the Mobile Device is not the last one, an attempt will be made to update it, requesting the corresponding confirmation.
 
I am notified that until the application is updated, I will not be able to continue operating. Download or modification of the Mobile Device In case you request the cancellation or modify the Mobile Device in such a way that it is not possible to use the App I undertake to notify this circumstance to the Bank, through the channel enabled by the Bank to such an end I will be exclusively responsible for the lack of notification of this fact, as well as for the claims or operations that may arise.
 
I notify myself that the channel enabled by the Bank such managements is Online Banking. Costs The costs that can be applied to me by the companies that transmit this information to my Mobile Device will be those that correspond with the plan, credit or billing system that I have selected with that company.
 
This considering that the choice of the company has been made on my own account and in my sole discretion. Security The access codes and user of Online Banking are personal, secret and non-transferable, therefore I assume the consequences of its disclosure to third parties, freeing the Bank of any liability that may arise.
 
For this reason, any connection from a Mobile Device made by any person providing my Online Banking password and user and my identity document must be understood as made in my name, and the Bank may consider that the derivative transactions are valid, legitimate and authentic without need to make or take any other shelter.
 
I approve the initiatives adopted by the Bank to preserve the computer security of the content provided through the  App, considering that the Bank always makes its best efforts in this task.
 
Therefore, I agree to adapt to the modifications made by the Bank in the presentation of the services included in the App when they are aimed at preserving the inalterable and confidential nature of the information sent to me. To every event is conferred by the present.
 
Inactivity control When I finish operating, I am notified that I must complete the process through the "Exit" option. As in the Internet channels, inactivity will be controlled in the client's session, once it reaches the maximum inactivity , that has been established 5 minutes, it will be considered that the client has finished the session.
 
In this case, the client must re-enter the application. Topes Mobile Banking may incorporate restrictions on the movement of funds in Online Banking, affecting this cap on the operations of money movements and the acquisition of financial products that may eventually be incorporated into the service. Authorization I expressly authorize the Bank, for security reasons, to record the operations it performs, for any of the services it uses and to use this material, possibly, as a means of proof before judicial instances.
 
Suspension of the Service Pursuing the welfare of its customers, the Bank may be obliged to make temporary suspension of the service, which will be notified in a timely manner as the event that motivates the suspension is predictable.
 
The Bank may suspend the App service to those customers that violate these Terms and Conditions or any of the remaining management rules in force for the Bank's services. The suspension of the  App service, in a definitive manner, can be decided by the Bank and will be communicated in advance to its clients in a timely manner, thus removing any type of responsibility from the Bank for the damages and losses that the suspension entails. If the suspension of the App, temporary or definitive, comes from a unilateral action of the cellular telephone company, the Bank will not be responsible for the adverse effects caused by said suspension.
 
The temporary or definitive suspensions made by the cellular telephony operator of my choice or those made by any other company responsible for transmitting the information, are not the Bank's competence, since they depend on the management policies of such companies, the which do not form a partnership with the Bank. The use of the App is not mandatory, even when it is incorporated in Online Banking and available for use in the company of cellular telephony, Internet services or transmission of information. Each service of the App & nbsp; or offered within these same Terms and Conditions, which I will accept upon joining the service for the first time or renewing the subscription that has been canceled.
 
Technical conditions of the Mobile Device: Android Mobile Devices Require operating system Android 4.1 or higher. IPhone Mobile Devices Requires iPhone OS 7.1 or higher. For other Mobile Devices A.
 
In the event that it is decided to install the App service in another Mobile Device other than those mentioned above, said installation will be conditioned to the Mobile Device meeting the technical conditions necessary for the provision of the service.
 
B. In the affirmative case, the installation will be carried out, and consequently all the Terms and Conditions ut-supra referred to will automatically be reproduced and valid, with the exception that it is another Mobile Device.
